This workshop is appropriate for all librarians and staff, especially those who work with interlibrary loans. Academic and school library staff are encouraged to attend. |
This session includes a review of basic copyright provisions, including factors in copyright risk management. Two important provisions of the copyright law impacting libraries, archives, and related entities (sections 107 and 108) will be discussed in detail. Other topics will include – • Digital content. • Old and new (TEACH Act) rules covering the classroom exemptions. • Service provider (section 512) and circumvention/trafficking (section 1201) provisions of the DMCA. Questions will be taken throughout the afternoon and at the conclusion of the program.
By the end of the program participants will . . . • Understand the basic law of copyright and how these factors can affect assessment of legal risk. • Apply the four fair use factors to evaluate copyright problems. • Understand the benefits and shortcomings of section 108, the main library and archive provision of the copyright law. • Understand the “rules” regarding use of material in both face-to-face and distance education environments. • Assess the obligations imposed on an academic institution that desires the protection of the section 512 “safe harbor”. • Become aware of the major elements of a licensing agreement and compare the rights and responsibilities governing use of content governed by a license to content governed by copyright.
Presenter: Professor Tomas Lipinski, J.D, LL.M, Ph.D has worked in a variety of legal settings including the private, public and non-profit sectors. In summers, he is a visiting faculty member at the Graduate School of Library and Information Science, University of Illinois at Urbana-Champaign where he teaches courses in information policy and legal issues for libraries and information managers. Professor Lipinski teaches, researches, and speaks frequently on various topics within the areas of information law and policy, especially copyright, free speech and privacy issues in schools and libraries. He is a national leader in copyright education, developing and teaching online continuing education courses for ACRL and the University of Maryland College Park, Center for Intellectual Property.
